Scope:
This Privacy Policy covers our collection, use and disclosure of information about identifiable individuals (“Personal Information”), who visit our Website, purchase or otherwise subscribe to the Services (“Subscribers”) and/or who participate in our Affiliate Program (“Affiliate”), collectively referred to as (“Users”) as well as Personal Information that our clients store in the Services to run their businesses, which may include Personal Information of our clients’ Prospects (“Prospects”). We process Prospects’ Personal Information on behalf of our Users.
TheBizKit™ does not knowingly collect Personal Information from children under the age of 16. If you are under the age of 16, please do not submit any Personal Information through the Website or Services. If you have reason to believe that a child under the age of 16 has provided Personal Information to TheBizKit™ through the Website or Services, please contact us, and we will endeavor to delete that information from our databases.
This Privacy Policy does not apply to the practices of companies that we do not own or control, including our Subscribers who may use the Services to collect Personal Information of third parties. If you submit any Personal Information to TheBizKit™ or the Platform, you are responsible for ensuring that you have obtained the necessary authorizations and consents from the relevant individuals to make such Personal Information available to us for use in accordance with this Privacy Policy, including any contact lists (from social media websites or otherwise) that you may import into the Platform.
The Website or Services may contain links to other web sites or services not operated or controlled by Company (“Third-Party Services”). The policies and procedures we described here do not apply to the Third-Party Services. The links from the Website or Services do not imply that we endorse or have reviewed the Third-Party Services. We suggest contacting those third parties directly for information on their privacy policies.

1.0 The personal data we collect:
We may collect and store the following information when running the Services for our own purposes:
1.1 User Information:
When you register for an Account, TheBizKit™ collects your name, email address, Country, Province/State, Company Name you represent, profile picture (optional).
1.2 Usage Information:
When Users use the Services, TheBizKit™ collects information about their activity and transaction history. In particular, TheBizKit™ keeps track of the device used to log in, the time of day, the time spent on the app, location, actions completed and IP address.
1.3 Location Information:
We may collect Location Information, that includes GPS data from devices and a rough estimate of location from IP Addresses.
We may collect and store the following information when running the Services on behalf of our Subscribers, Affiliates & Reps:
1.4 Subscriber (and prospective client) Information:
To provide the Services to our Subscribers, we collect Personal Information that may include names, contact information, orle types, billing preferences and order history, which we use for the purposes set out below.
1.5 Personal Information of our Subscribers’, Affiliates, and Prospects:
Subscribers who pay for the service use the Services to store Personal Information of their Prospects. As result, we collect and store Personal Information on behalf of our paying Subscribers related to such individuals, including name, email address, phone number, and social media accounts. Our Subscribers have the ability to add custom fields which prevents TheBizKit™ from knowing all types of information stored. It is important to note that although Subscribers will have visibility to the “business activity” of their invited Downline Subscribers, they do NOT have access to the personal data of their Prospects. All that will be exposed to an upline is a unique prospect ID and the business status of that prospect.
2.0 Data Usage and Privacy ;
2.1 Data Ownership:
All data provided by the Client to TheBizKit™’ through the use of the software remains the property of the Client. This includes the structure of the subscriber's company and downline information. TheBizKit™’ acknowledges that it has no ownership rights over the Client's data.
2.2 Data Usage:
TheBizKit™’ will use the Client's data solely for the purpose of providing, maintaining, and improving the software services. The data will not be used for any other purposes without the Client's explicit consent.
2.3 Prohibition of Data Usage Outside the Software
TheBizKit™’, including its CEO, owner, employees, and contractors, are prohibited from using or sharing the Client's data for any purpose outside the scope of the software services and it's metrics. This includes, but is not limited to, using the data for personal gain, external research, marketing, or sharing with third parties without the Client's explicit consent.
2.4 Data Privacy:
TheBizKit™’ commits to maintaining the confidentiality and privacy of the Client's data. Access to the data will be restricted to authorized personnel who need access to perform their job functions.
2.5 Personal Information for Providing the Service:
Personal or Business Information is or may be used for: (i) to verifying a User’s identity; (ii) Allowing Users to create a profile on the Platform; (iii) Storing log-in credentials to allow Users to sync the Platform to their existing virtual back office; (iv) providing the Services to our Subscribers and Users, including allowing Subscribers to manage transactions and accounts of their Reps and Prospects; (v) Contacting Users about relevant information related to the Services; (vi) Allowing Users to keep track of their history; (vii) Maintaining TheBizKit™’s accounting records; (viii) Enhancing and customizing User experience, including showing Users relevant content; (ix) Diagnosing technical problems; and (x) Monitoring compliance with our Terms of Service.
2.6 Analytics:
We also collect some information (ourselves or using third party services) using logging and cookies, such as IP address, which can sometimes be correlated with Personal Information. We use this information for the above purposes and to monitor and analyze use of the Services, for the Services’ technical administration, to increase our Services’ functionality and user-friendliness, and to verify users have the authorization needed for the Services to process their requests. We may use Google Analytics, Amplitude, or similar third-party services for these purposes. 3.0 Purchases:
If you Create a Subscription Account or any in-app purchases, TheBizKit™ will integrate to a third-party payment processor who will request and collect credit card and billing information and preferences. You hereby agree that all payments will be processed using TheBizKit™’s third-party payment processors (listed on our Sub-Processors Page) and that all such payments will be governed by such party’s terms and conditions available.
4.0 Payouts:
If you have elected to be an Affiliate, TheBizKit™ will integrate to a third-party payout solution Trolley. You hereby agree that all account information and preferences will be processed using TheBizKit™’s third-party payment processors is Trolley (listed on our Sub-Processors Page) and that all such payments will be governed by such party’s terms and conditions available.
5.0 Communications:
TheBizKit™ will use the contact information provided to notify Users of important information that is relevant to the Services and for marketing communications if the User chooses to opt in. Despite your indicated e-mail preferences, we may send you relevant notices where permitted by law.
6.0 Cookies:
Tracking technologies, such as cookies, beacons, scripts, and tags, are used by us and our third-party partners. These technologies are used in analyzing trends, administering the Website or Services, tracking Users’ movements around the Website or Services, gathering demographic information about our user base as a whole and collecting information about your browsing activities over time and across different websites following your use of the Website. We may receive reports based on the use of these technologies by these companies on an individual and aggregated basis. Various browsers may offer their own management tools for removing these types of tracking technologies. Alone, cookies do not identify you personally. They merely recognize your browser.

7.0 Disclosure of personal information with third parties:
7.1 Subscribers:
Where TheBizKit™ is providing the Platform and/or Services to our Subscribers, then all Personal Information collected on behalf of the Subscribers through the Platform is made available to the Subscriber, downline/rep information, prospect information, transaction information, as well as transcripts from support communications and survey results related to the Subscriber’s products. Subscribers are responsible for compliance with their own privacy policies as well as applicable privacy laws.
7.2 Affiliate:
Where TheBizKit™ is providing the Platform and/or Services to an Affiliate, then all Personal Information collected through the account creation is made available to the Affiliate, including all future commission/referral details in their Profile. Affiliates are responsible for compliance with their own privacy policies as well as applicable privacy laws.
7.3 Service Providers:
We may from time to time employ or engage other companies and people to perform tasks on our behalf and need to share Personal Information with them to provide the Services. We reserve the right to use customer data to improve our products and services and to provide such third parties with the Personal Information that they need to perform their specific function. This includes third party companies and individuals employed or engaged by us to facilitate our products and services, including the Sub-Processors listed here, and businesses who engage our Services (to the extent provided for above).
7.4 Business Transfers:
If we (or any of our assets) are acquired, or if we go out of business, enter bankruptcy, or go through some other change of control (collectively a “Transaction”), Personal Information may be made available or otherwise transferred to the new controlling entity during the diligence process or during or after the Transaction, where permitted under applicable law.
7.5 Subsidiaries or Affiliated Companies:
We may also share your Personal Information with our subsidiaries or other affiliated companies for purposes consistent with this Privacy Policy.

8.1 Storage Location:
TheBizKit™™ stores its data, including Personal Information, on virtual servers offered through Google Cloud Services - Compute Engine. By submitting any Personal Information or using the Services, you agree to this transfer, storing or processing of your Personal Information in the United States. You acknowledge and agree that your Personal Information may be accessible to law enforcement and governmental agencies in those countries under lawful access regimes or court order.
8.2 Security:
The security of your Personal Information is important to us. We use commercially reasonable efforts to store and maintain your Personal Information in a secure environment. We take technical, contractual, administrative, and physical security steps designed to protect Personal Information that you provide to us. We have implemented procedures designed to limit the dissemination of your Personal Information to only such designated staff as are reasonably necessary to carry out the stated purposes we have communicated to you. However, no Internet or email transmission is ever fully secure or error free. In particular, email sent to or from the Services may not be secure. Therefore, you should take special care in deciding what information you send to us via email. Please keep this in mind when disclosing any Personal Information to us via the Internet. You are also responsible for helping to protect the security of your Personal Information. For instance, never give out your email account information or password for the Services to third parties.

If you re-subscribe using the same email address to our program your data will be returned to you by nature of the application.

We may disclose User Information to Subscribers, Service Providers, Affiliates, advertising partners, and unaffiliated entities that you request that we integrate with.

We may disclose Usage Information to Subscribers, Service Providers, and Affiliates..

We may share Location Information with unaffiliated entities that you request that we integrate with.
Subscriber and Prospective Subscriber Information
We may disclose User Information to Subscribers, Service Providers, Affiliates, advertising partners, and unaffiliated entities that you request that we integrate with.
Reps and Prospects
We may share Personal Information with the relevant Rep and/or Subscriber who is using the Services to store Personal Information of their Reps or Prospects.
To the extent provided for by law and subject to applicable exceptions, California residents have the following privacy rights in relation to the Personal Information we collect:
· The right to know what Personal Information we have collected and how we have used and disclosed that Personal Information;
· The right to request deletion of your Personal Information;
· The right to opt out of sales: We do not make your Personal Information available for purchase. If you do not have an account with us, or if we suspect fraudulent or malicious activity, we may ask you to provide additional Personal Information and proof of residency for verification. If we cannot verify your identity, we will not provide or delete your Personal Information.
Authorized Agents: You may submit a request to know or a request to delete your Personal Information through an authorized agent.
